It must be remembered that timber and bamboo are natural products and will be subject to movement and weathering as they season. Wood is hygroscopic, which means that it will take in moisture when in damp and/or wet weather conditions and environment.
Wood will also dry out and expel moisture when in warm or hot weather conditions. This movement in the wood caused by ingress and egress of moisture causes the wood to show signs of stress which in turn, in layman's language, may appear as splits and fissures.
It is not uncommon for small splits to occur (called 'shakes') in timber when drying and warping when timber is allowed to dry too rapidly. These will normally go back when the humidity rises. These splits, fissures and knots are not detrimental to the strength of the wood and are all part of the natural appearance of wood. These will tend to open and close with the change in the moisture content.
Acceptable limits are defined in the relevant British Standard.

You need to look at your Deeds or contact your Solicitor to check your Deeds. These should indicate which fence is your responsibility.
It would be a good idea to let them know what sort of condition the fence is in - it may well be that they can't see it from their side.
You could offer to 'go halves' on the cost in order to get the job done. If, however, they do not wish to replace the fence, then you could erect a new fence on your land, inside the existing fence.
This is one of the most consistently asked questions. Years ago many people believed you always had to give your neighbour the 'good side'. Nowadays, the majority of fences are fitted between concrete posts, so it doesn't matter which way the fence faces. However, as in any case, when replacing fencing, it's a good idea to let your neighbour know first what you are thinking and doing.
